What is the job registration requirement and how does it work? This page contains the most important information about the job registration requirement and what employers must comply with since July 1st 2018.

Job registration requirement coming into force

On 8 December 2017, the Swiss Federal Council agreed on how to implement the Act for Implementing the Article of the Constitution for Managing Immigration (Art. 121a of the Swiss Federal Constitution) – also known as the “mass immigration initiative” – at ordinance level. Since July 1st 2018, the job registration requirement has been in place. Since then, the following process must be followed for vacancies that are subject to the job registration requirement.

When does the job registration requirement not apply?

The registration requirement does not apply in the following cases:

 
Jobs filled by job-seekers registered with an RAV.
 
Jobs within a company, an association of companies or a group that have been filled by internal staff employed there for at least six months; this also applies to apprentices employed following an apprenticeship.
 
Employment lasting a maximum of 14 calendar days.
 
Employment of persons connected with an authorised signatory in the company through marriage or a registered partnership, or through blood or through marriage in a straight line or up to the first degree in a collateral line.

The list of occupation groups subject to the job registration requirement will be updated once a year by SECO. Individual cantons can also request the registration requirement for additional occupation groups. You will find the latest version on this information page.

What needs to be registered?

Which information about the vacancy must be registered with the RAV? According to the ordinance regarding employment services, the following information must be sent to the responsible RAV:werden:

1. Employers must register job vacancies in the occupation types according to Article 53a Paragraph 1 with the corresponding local office of the public employment service.

  • Occupation sought
  • Activity, including special requirements
  • Place of employment
  • Workload percentageensum
  • Starting date of the job
  • Type of employment contract: temporary or permanent
  • Contact address
  • Company name

How does registration take place?

How are jobs registered with the RAV?

  • Via electronic interface
  • RAV internet platform (Job Room)
  • By telephone
  • During a personal visit
The RAV closest to the employee’s future place of work is the RAV responsible
  • For temporary staffing: Location of the hiring company
  • For permanent employment services: Location of the new employer
 
 

What penalties apply?

What penalties apply for violations of the job registration requirement?

Fines of up to CHF 40,000 for wilful
  • violation of the registration requirement or
  • failure to conduct an interview or a declaration of aptitude for suitable candidates
The maximum fine for unintentional violation is CHF 20,000
The penalties are applied for each violation
